ADVERTISING OCCUPANCY OF DWELLINGS AS IT RELATES TO DWELLINGS ON SEPTIC SYSTEMS: 
It has come to our attention that existing and new homes as well as rental and leased property are being advertised showing the number of actual bedrooms in the dwelling, not by the septic permit specifications that are issued by the county.  Ex:  If the county issued a septic permit for a 2 bedroom home, the home should not be advertised as a 4 bedroom.  It is the responsibility of the listing agent/listing firm to know the occupancy limit on the septic permit.  Should this be ignored, the listing agent could be subject to purchasing a septic system that would accommodate the number of bedrooms advertised by the listing company, not to mention censure by the NC Real Estate Commission for not clearly advertising material fact.  To read this article from the NCREC’s bulletin click here.
